“The polygraph, or “lie detector” is an instrument that measures and records physiological responses like breathing rate, pulse, blood pressure and perspiration. The underlying theory of the polygraph is that when people lie they get measurably nervous about lying. Its name stems from “poly” for the multiple sensors used and “graph” for a single strip of moving paper that records information, although most polygraph examiners now use computer images instead of analog instrumentation. A polygraph examiner is generally a highly trained interrogator as well as the technical operator of the devise and will use their experience in addition to the machine to detect your truthfulness.

One of the most intimidating parts of the polygraph exam is being attached to the sensors that will collect physiological data from at least three systems in the human body. After being attached to four to six sensors, your polygraph exam will likely start with a pre-test interview to gain some preliminary information which will later be used for control questions; this is called the “Control Question Test,” or CQT. “An Arizona mother said she felt “like she hit the jackpot” after King County sheriff’s detectives made an arrest in the 2006 slaying of her daughter.

Gael Schneider said her former son-in-law, Martin David Pietz, was long considered the key suspect in the strangulation of Nicole Pietz, of Lynnwood. Pietz, 34, was arrested Wednesday outside his job at a Chase Bank branch in Kirkland and charged with second-degree murder.

Police said DNA and cellphone records link him to the crime.

“These six years and 54 days have been hell,” Schneider said Wednesday by phone from her home in Arizona. “I am so elated. This isn’t going to bring my daughter back to me, but it’s going to give her some justice and she certainly deserves that.”

The body of Nicole Pietz, 32, was found in Burien in February 2006 about a week after her husband reported her missing.

Pietz’s husband, who uses his middle name, David, has denied any culpability in her death. However, he failed a polygraph shortly after she was killed, says an affidavit of probable cause released Wednesday.

Investigators have not revealed a clear motive for the slaying, other than saying the couple had financial and marital problems.

Detectives also say David Pietz cheated on his wife. Charging documents say investigators found searches on the Pietz home computer for “swingers” clubs and “how to cheat on your spouse.”

David Pietz, who hired a lawyer shortly after his wife’s disappearance, is being held in lieu of $1 million bail.

According to charges:

David Pietz beat and strangled his wife at their Lynnwood-area condominium on the night of Jan. 27, 2006, or early the next morning. He then left her nude body in woods in Burien.”

“A polygraph, or “lie-detector,” is a machine that measures various physical attributes (blood pressure, perspiration, heart rate, etc…) and attempts to correlate them with telling lies.  In past times they were often used by police and government agents to interrogate suspected criminals, but as they have been proven to be extremely unreliable indicators of lying, their use has lessened in recent years (usually because of court rules prohibiting their use).

If I am Arrested For a Crime, Can I be Forced to Take a Polygraph?

No!  In no state can anyone be forced by the police or anyone else to take a polygraph examination.  However, many people are not aware of this, and police can often apply plenty of psychological pressure on a suspect to the effect that not taking the test is an automatic admission of guilt.   Moreover, refusing to take a test may often convince police that you are guilty, at which point you may be harassed and searched until some kind of evidence is found.  But even if one agrees to take a polygraph test and passes it, if the police consider you a suspect, they may believe you “beat the test” rather than told the truth, making it somewhat of a lose-lose situation.

What are the State Laws Concerning Polygraph Admissibility?

Almost every state fits into one of two categories; those that find them completely inadmissible and those that allow their admission with “the stipulations of both parties” (meaning both you and the prosecutor agree to admit the test results as evidence).

States like California, Arizona, Nevada, Georgia, and Florida allow the tests if everyone agrees to them, but may put different emphasis on the tests accuracy.

• California, for instance, presents the results to the jury, and allows them to draw whatever inferences from it they wish.
• Georgia, on the other hand, allows defendants who suffer damage because of a false result on a polygraph test (which are somewhat frequent) to sue the polygraph operator for damages and attorneys fees.
• Florida is the one state that does require some people to submit to polygraph tests (previously convicted sex offenders), but even then those test results cannot be used against them in court, and are for use only within the course of their therapy.

The states in which polygraphs are inadmissible include New York, Texas, Illinois, Pennsylvania, and the District of Columbia.  In these states, even if both parties wish to enter polygraph test results into evidence, it is forbidden (except in very rare scenarios).

• Some states, like New York and Texas, forbid their use completely in all employment and law enforcement contexts.
• Other states, like Massachusetts, do not allow them to be entered as evidence, but CAN use them as supporting probable cause (to obtain search warrants).

Federal courts have their own rules on when to allow the admission of polygraph evidence (it is usually at the judge’s discretion).”

“The use of polygraphs is a very controversial topic in today’s courts. In United States v. Frye (1923) [14], lie detectors were excluded from evidence on the premise that they were not generally accepted in the scientific community. While polygraph tests are commonly used in police investigations in the US, no defendant or witness can be forced to undergo the test. In United States v. Scheffer (1998) [15], the U.S. Supreme Court left it up to individual jurisdictions whether polygraph results could be admitted as evidence in court cases. Nevertheless, it is used extensively by prosecutors, defense attorneys, and law enforcement agencies who believe in its utility. In the States of Massachusetts and Maryland, it is illegal for any employer to order a polygraph either as conditions to gain employment, or if an employee has been suspected of wrongdoing. The Employee Polygraph Protection Act of 1988 (EPPA) generally prevents employers from using lie detector tests, either for pre-employment screening or during the course of employment, with certain exemptions.

In the United States, the State of New Mexico admits polygraph testing in front of juries under certain circumstances. In many other states, polygraph examiners are permitted to testify in front of judges in various types of hearings (Motion to Revoke Probation, Motion to Adjudicate Guilt).

In 2007, in Ohio v. Sharma, an Ohio trial court overruled the objections of a prosecutor and allowed a polygraph examiner to testify regarding a specific issue criminal examination. The court took the position that the prosecutors regularly used polygraph examiner to conduct criminal tests against defendants, but only objected to the examiner’s testimony when the results contradicted what they hoped to achieve.Louis Rovner, a polygraph examiner from California, polygraphed the defendant and testified both at a pretrial admissibility hearing and at trial. The defendant, who had been charged with sexual battery, was acquitted.”
